Godeza Jewellery - Terms & Conditions

At GODEZA Jewellery, every piece is custom-designed and meticulously crafted. By placing an order with us, you agree to the following Terms & Conditions. Please read them carefully, as they are designed to be mutually beneficial while ensuring transparency, fairness, and clarity throughout the bespoke jewellery process.

1. Bespoke Nature of Our Jewellery

All GODEZA Jewellery pieces are custom-made to order. This includes, but is not limited to, design development, stone sourcing, metal selection, sizing, and finishing. As a result, all orders are treated as final once confirmed and approved.

2. Returns & Exchanges

Due to the bespoke nature of our work:

  • Returns and exchanges are not accepted once an order has been confirmed and production has commenced.
  • This applies to all custom-designed, made-to-order, and personalised items, including engraved pieces.

3. Ownership & Full Payment

All jewellery items remain the sole property of GODEZA Jewellery until full and cleared payment of all amounts due has been received, irrespective of collection, delivery, possession, partial payment, or any other circumstances.

Ownership of the item shall transfer to the client only once payment has been settled in full. Deposits or interim payments do not constitute transfer of ownership.

GODEZA Jewellery reserves the right to withhold delivery, suspend completion, or reclaim any item in the event of non-payment, failed payment, chargeback, or reversal of funds. Until ownership has transferred, items may not be resold, altered, pledged, insured, or otherwise disposed of by the client.

4. Limited Warranty

All GODEZA Jewellery pieces carry a limited warranty of six (6) months from the date of delivery or collection.

Warranty Coverage

The warranty covers:

  • Manufacturing defects attributable to workmanship or materials used by GODEZA Jewellery.

In the event of a valid warranty claim, we reserve the right to:

  • Repair the item,
  • Replace the item,
  • Or, at our discretion, offer an exchange of equal value.

Warranty Exclusions

The warranty does not cover:

  • Normal wear and tear,
  • Accidental damage,
  • Improper use or care,
  • Alterations or repairs carried out by third par 
  • Damage resulting from resizing, cleaning, or modifications not performed by GODEZA Jewellery.

Where damage is determined to fall outside the scope of the warranty, we reserve the right to decline the claim or offer repairs at the client’s expense.

5. Shipping, Delivery & Collection and Transfer of Risk

Shipping

  • Shipping arrangements are handled on an individual basis and depend on the availability and timelines of third-party courier services.
  • While every reasonable effort is made to ensure timely dispatch and delivery, delivery dates cannot be guaranteed once the parcel has been handed to the courier.
  • Delays caused by couriers or third parties are outside of our control and do not constitute grounds for cancellation or refund.

Collection & Local Delivery

  • Collection may be arranged by prior agreement at Vee and Forti’s Wine Emporium, Lynnwood Bridge, C/o Daventry & Lynnwood Drive, Pretoria East.
  • Complimentary local delivery may be offered within a 10 km radius of the above location, subject to agreement.
  • Deliveries beyond this radius will incur additional charges, unless explicitly included in the original quotation.

Transfer of Risk

  • Responsibility and risk for the jewellery transfer to the client once the item has been collected, dispatched, or handed to a courier or third party.
  • Transfer of risk does not constitute transfer of ownership, which remains subject to full and cleared payment in accordance with these Terms & Conditions.

6. Stones Disclosure & Transparency

We are committed to full transparency regarding all gemstones used in our jewellery.

At all times, we will clearly disclose whether stones are:

  • Naturally earth-mined,
  • Synthetic,
  • Laboratory-grown.

Any known treatments, enhancements, inclusions, or unique characteristics will also be disclosed where applicable.

7. Stone Matching / Sourcing

  • We will make every reasonable effort to source and match stones according to client requests.
  • Natural gemstones inherently vary in colour, clarity, and characteristics; therefore, perfect matches cannot always be guaranteed.
  • Visual differences resulting from natural variation do not constitute defects.

8. Metals Disclosure & Alloy Testing

● Our jewellery may be crafted in various gold karats and platinum.
● We take all reasonable steps to ensure metal quality aligns with quotations and approved samples.
● Where required, metal alloys may be tested by a third-party spectrometer.
● Results from such testing will be accepted as final and binding by both parties.

9. Laboratory Testing & Certification

● Gemstone laboratory testing (e.g. GIA, EGL or equivalent) is not included unless explicitly stated in the quotation.
● Any representations made regarding gemstones are based solely on available testing, supplier disclosures, or
laboratory reports.
● Additional testing may be arranged at the client’s request and expense.

10. Design Approval & Sign-Off

Prior to production, clients will be provided with final design drawings, CAD models, or 3D renders for approval.
● Written approval (via email, WhatsApp, or message) constitutes final design sign-off.
● Once approved, changes may not be possible or may incur additional charges and extended lead times.

11. Sizing Guidelines & Resizing

● Downloadable sizing guides are provided for client assistance.
● Clients are responsible for confirming accurate sizing prior to production.
● In-person sizing offers the most reliable outcome and is recommended where possible.
● Seasonal size fluctuations are normal.
● One complimentary resize may be included for qualifying designs, subject to assessment.
● Additional resizing or complex alterations may incur fees and are subject to design limitations.

12. Engravings

● Engravings are charged additionally, currently at R70 per character, with a maximum of 13 characters including

spaces, unless otherwise quoted.

● Only numerical and alphabetical characters are standard; select symbols may be possible by arrangement.

● Complex engravings will be quoted separately.

● All engraving details must be confirmed in writing.

● Once completed, engravings cannot always be altered or removed.

● Some designs may not allow engraving due to structural or aesthetic considerations.

13. Payments & Fees

● EFT payments directly to our designated account are preferred but additional methods maybe be agreed upon.
● Additional fees may apply for:
o SWIFT transfers,
o Card terminal payments,
o Cash deposits.
● Any applicable fees will be added to quotations unless stated otherwise.

14. Pricing, Availability & Validity of Quotes

● Quotations are based on current material availability, labour, and specialist services.
● Unless stated otherwise, quotes are valid for 48 hours.
● Pricing may be affected by:
o Exchange rate fluctuations,
o Supplier price changes,
o Availability of stones, metals, or specialist services.
● Where variable margins cannot absorb such changes, we reserve the right to adjust pricing, with clear
communication and approval from the client before proceeding.

15. Exchange Rates & Imported Materials

For orders involving imported materials or services:
● Final pricing may vary due to exchange rate movements or supplier adjustments.
● Any such changes will be communicated transparently prior to continuation of the order.

16. Client-Supplied Materials & Redesigns

● When redesigning existing jewellery or using client-supplied stones or metals, inherent risks may exist.
● We cannot guarantee:
o Metal purity as perceived or stated,
o Stone origin, integrity, or durability prior to assessment.
● Findings from testing or inspection are considered final.
● A liability waiver applies for defects, breakage, or loss arising from pre-existing weaknesses.
● Clients remain responsible for insurance cover on all supplied materials.
● When redesigning or reworking existing jewellery, processes such as unsetting stones or structural alteration may be
required and carry inherent risks, particularly where materials are aged, worn, treated, or structurally compromised.
By instructing GODEZA Jewellery to proceed, the client acknowledges and accepts these risks and agrees that
GODEZA Jewellery shall not be held liable for damage, breakage, or loss arising from the necessary reworking
process itself, provided reasonable care has been exercised.

17. Liability, Insurance & Third Parties

● While all reasonable care is taken, GODEZA Jewellery accepts no liability for loss, damage, or theft once third parties
are involved.
● Insurance is strongly recommended for all high-value items.
● Liability transfers to the client upon collection, dispatch, or courier handover.

18. Cancellations & Deposits

● If an order is cancelled after payment of a deposit, the deposit will be forfeited.
● The minimum value of a deposit will be 30% of the total order value.
● We reserve the right to retain funds to cover:

o Materials purchased or used,
o Specialist services engaged,
o Labour and time invested,
o Any other costs incurred up to the point of cancellation.

19. Care, Wear & Aftercare

Fine jewellery is inherently delicate and requires mindful wear, regular care, and periodic inspection to preserve its beauty,  structural integrity, and longevity. Each GODEZA Jewellery piece is accompanied by a Care Card and an Aftercare & Maintenance Guide (www.godeza.com/aftercare), which are provided to support the long-term enjoyment of your jewellery.

By placing an order and wearing your piece, you acknowledge the importance of following these care and maintenance guidelines. While all jewellery is crafted to high standards, damage, stone loss, deformation, or accelerated wear resulting from accidental impact, improper use, exposure to harsh chemicals, neglect, or normal wear over time may affect warranty coverage or servicing options.

Routine care and professional inspections significantly reduce the risk of such issues and help ensure your bespoke piece maybe enjoyed for many years. Please refer to our Aftercare & Maintenance Guide for more information about our complimentary services.

20. Insurance Valuations

GODEZA Jewellery offers insurance valuation certificates for all GODEZA-created pieces as a complimentary service, provided sufficient information and access to the item are available. Valuations are intended for insurance purposes only and reflect replacement value at the time of assessment.

Valuations should be reviewed and updated approximately every two (2) years to ensure insured amounts remain current in the event of loss, damage, or theft. 

Valuations for non-GODEZA jewellery may be undertaken at our discretion and may incur additional fees, particularly where specialised services are required, including but not limited to metal testing, gemstone grading, or laboratory analysis. Any applicable costs will be communicated and approved prior to proceeding.

GODEZA Jewellery accepts no responsibility for underinsurance where valuation updates have not been maintained or where valuations are not submitted to an insurer.

21. Amendments to These Terms

GODEZA Jewellery reserves the right to amend these Terms & Conditions at any time.

● The most current version will be published on our website.

● Updated Terms & Conditions will apply to all new orders placed after publication.

22. Dispute Resolution & Good-Faith Clause

At GODEZA Jewellery, we value respectful communication and long-term client relationships.

● In the unlikely event of a dispute, both parties agree to first attempt to resolve the matter in good faith through open and constructive dialogue.

● Clients are encouraged to notify us in writing of any concerns within a reasonable time after discovery.

● Where a resolution cannot be reached amicably, the matter may be referred to mediation prior to the initiation of formal legal proceedings.

● Legal action, where unavoidable, shall be subject to the laws and jurisdiction of the Republic of South Africa.
